Terms of Service

1. Agreement

These Terms of Service ("Terms") govern access to and use of EstateLoop's website, mobile application, and related services. EstateLoop is operated by its current owner/operator. EstateLoop is not yet incorporated as a private limited company. Once a legal entity is registered, its exact name, registered office, CIN, GSTIN, and other statutory details will be inserted consistently across all legal pages below.

When you create an account you tick a single checkbox: "I am 18+ and agree to the Terms". Our Privacy Policy and an itemized "What we collect" notice are linked at signup — they are not extra checkboxes. Optional analytics and marketing stay off until you opt in under Privacy & data. If you do not agree to these Terms, do not use EstateLoop.

If you use EstateLoop on behalf of a company or other entity, you represent that you have authority to bind that entity to these Terms.

These Terms are not legal advice. They describe how EstateLoop operates the platform. You should obtain independent legal advice for property transactions.

2. Eligibility

• You must be at least 18 years old and legally capable of entering into a contract under Indian law
• You must provide accurate registration information and keep your account credentials secure
• One individual may maintain only one personal account unless we authorize business use
• Agents, brokers, and builders must accurately disclose their role and authorization to represent listings
• You must comply with all applicable laws while using the platform

3. Nature of the Platform

EstateLoop is a technology platform that helps users discover property listings and communicate with other users in India, with an initial focus on Mumbai. We are not a real estate broker, real estate agent, property dealer, escrow provider, legal adviser, title insurer, surveyor, or party to any sale, purchase, lease, leave-and-licence, or other property transaction between users.

• EstateLoop does not take possession of property or act as a custodian of physical keys or documents
• EstateLoop does not hold token money, deposits, rent, sale proceeds, security deposits, or other transaction consideration between users
• Any agreement for a property is solely between the users and/or third parties involved. EstateLoop does not guarantee that a transaction will complete, that title is clear, or that registration formalities will be completed
• Payment processing on EstateLoop is for platform products (such as plans, passes, boosts, and wallet top-ups), not for property purchase or rent between users

Where applicable, advertisers of real estate projects must comply with the Real Estate (Regulation and Development) Act, 2016 (RERA) and related state rules. You are solely responsible for obtaining and displaying any registrations, disclosures, or approvals required for your listings or advertising. EstateLoop does not guarantee your compliance with RERA or other laws.

4. Platform Services

Subject to these Terms, EstateLoop may provide:

• Property discovery through card-based browsing, search, and filters
• Direct chat, offers, and contact features between buyers, renters, owners, agents, and builders
• Paid platform features such as Swipe Day Passes, buyer plans, owner/agent/builder plans, property boosts, project boosts, boost credits (when granted), and in-app wallet functionality
• Listing review, verification signals, moderation, and reporting tools (which do not guarantee authenticity)

Features may change, be limited by plan, geography, or device, or be unavailable during maintenance. We do not guarantee continuous, error-free, or uninterrupted service.

5. User Responsibilities

5.1 All users

• Use EstateLoop lawfully and in good faith
• Provide truthful account information and keep your profile accurate
• Do not impersonate others, create fake accounts, or misrepresent your role
• Do not harass, threaten, spam, defraud, or discriminate against other users
• Do not scrape, reverse engineer, overload, or attempt unauthorized access to our systems
• Do not circumvent platform controls, fees, or verification requirements
• Do not commit payment fraud or abuse wallet, boost, or plan entitlements
• Comply with applicable consumer, advertising, housing, and data-protection laws

5.2 Sellers, owners, agents, and builders

• List only properties you own or are lawfully authorized to advertise
• Provide truthful descriptions, pricing, photos, availability, location, and material facts
• Do not upload fake, forged, or misleading documents
• Do not post duplicate, bait-and-switch, or stolen-photo listings
• Comply with RERA, local housing, advertising, tax, and consumer laws that apply to you
• Do not misrepresent verification status, ownership, or authority
• Update or remove listings that are sold, rented, or otherwise unavailable
• Respond to genuine inquiries professionally and without harassment

5.3 Buyers and renters

• Use the platform for genuine property interest only
• Independently conduct site visits, legal due diligence, title checks, society or building approval checks, and document verification before paying any token, deposit, or consideration
• Do not misuse contact details or harass other users
• Never transfer money to unknown parties solely because a listing appeared on EstateLoop
• Never share OTPs, UPI PINs, or passwords with other users

6. Agents & Builders

If you use EstateLoop as an agent, broker, or builder, you must accurately disclose your role in your profile and listings and ensure you have authority to advertise the relevant properties or projects.

• You are solely responsible for your licences, registrations, disclosures, and compliance with applicable law
• Any brokerage, commission, or service fee you charge users is separate from EstateLoop's platform fees and is governed by your arrangement with those users
• EstateLoop is not responsible for an independent agent's or builder's legal compliance, representations, or fees

7. Zero Brokerage Clarification

"Zero brokerage" on EstateLoop means EstateLoop does not charge a brokerage or commission fee for introducing or connecting users through the platform.

EstateLoop may charge separate platform or product fees for digital features such as Swipe Day Passes, buyer plans, owner/agent/builder plans, property or project boosts, and wallet top-ups. These are not brokerage.

Independent agents, brokers, or third parties may charge their own brokerage or service fees under a separate arrangement. EstateLoop does not control, collect, or guarantee those fees and is not responsible for disputes about them.

8. Pricing & Paid Features

Paid offerings may include, depending on your role and what is available in the app:

• Swipe Day Pass — temporary access to additional property swipes or discovery features for a defined period
• Buyer plans (for example Buyer Pro) — enhanced buyer-side features for a subscription period
• Owner, agent, and builder plans — enhanced listing, project, or posting features for a subscription period; eligible plans may include boost credits as a perk
• Property boosts — increased visibility for an individual property listing for a number of days, using boost credits (when available) and/or wallet balance at the in-app rate shown at checkout
• Project boosts — increased visibility for a builder project for a number of days, using boost credits (when available) and/or wallet balance at the in-app rate shown at checkout
• Boost credits — promotional units that can be applied toward boosts when granted through an eligible plan or by EstateLoop; boost credits are not sold as standalone packs in the app
• Wallet top-ups — prepaid balance used for eligible in-app purchases such as boosts when credits are insufficient

The prices, durations, entitlements, and inclusions shown in the EstateLoop mobile app at the time of purchase are controlling. The public website may describe plan benefits for marketing but does not publish a live INR price list. Confirm amounts in Passes & plans inside the app before you pay. Applicable taxes (including GST, if charged) will be shown at checkout where required.

We may change prices, features, or plans prospectively with reasonable notice where practicable. Changes do not affect amounts already paid for an active entitlement unless the product terms say otherwise.

9. Payments

• Payments for EstateLoop platform products are processed through Razorpay and/or other authorized payment providers
• EstateLoop does not store full card numbers or UPI PINs. Payment credentials are handled by the payment provider's secure infrastructure
• EstateLoop does not hold property transaction funds between buyers and sellers
• A successful payment to EstateLoop does not mean a property transaction is safe, verified, or guaranteed
• Failed transactions, duplicate charges, and payment disputes should be reported promptly to support@estateloop.in with your account email, amount, time, and payment reference
• Chargebacks made in bad faith may result in account suspension

Razorpay and other payment partners process payments under their own terms and privacy policies. Their role is limited to payment processing for EstateLoop platform products.

10. Refunds

Refund eligibility depends on the product purchased, whether it was used or consumed, and applicable mandatory consumer protection law. EstateLoop does not use a blanket "no refunds under any circumstances" rule.

• Unused digital products — may be considered for refund where the product has not been activated or consumed and applicable law allows
• Consumed digital products — generally not refundable once the benefit has been delivered (for example an active boost day or used swipe pass), except where required by law
• Technical non-delivery — if you paid successfully but the paid feature was not delivered due to a technical fault on our side, contact support with payment proof
• Duplicate or failed payments — report promptly; verified duplicates or failed debits may be reversed or credited
• Wallet balances and boost credits — generally non-transferable and non-refundable except where required by law or expressly stated in-product
• App store purchases — if a purchase is made through Google Play or the Apple App Store (when available), that store's refund rules apply; EstateLoop cannot override those policies

11. Verification Signals

EstateLoop may display verification badges, review status, or similar signals when a listing or user has passed specific EstateLoop checks described in our Safety & Verification policy.

"Verified" or similar labels do not mean:

• title is guaranteed or ownership is guaranteed
• legal due diligence has been completed by EstateLoop
• RERA approval or registration is guaranteed
• the property was physically inspected by EstateLoop unless explicitly stated
• a seller's identity is guaranteed beyond the stated verification process
• a transaction will complete successfully

Always verify independently before paying money or signing documents.

12. Prohibited Conduct

You must not:

• Post fake, duplicate, misleading, stolen, or unauthorized listings or projects
• Upload forged documents or impersonate an owner, agent, builder, or EstateLoop staff
• Run advance-fee scams, phishing, or fraudulent payment instructions on or off the platform
• Harass, threaten, spam, defraud, or post discriminatory housing advertisements where prohibited
• Circumvent platform fees, boosts, plans, or verification gates through abuse or automation
• Scrape, crawl, reverse engineer, overload, or attempt unauthorized access to our systems
• Use bots or unauthorized automation except through features we expressly provide
• Upload malware, illegal content, or content that infringes third-party rights
• Use the platform for money laundering or other unlawful activity

We may remove content, limit features, suspend, or terminate accounts that violate these Terms or create safety, fraud, legal, or regulatory risk. See our Listing Policy for enforcement steps.

13. User Content & Licence

You retain ownership of content you upload (including listing text, photos, and messages you send). You grant EstateLoop a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt for display, communicate, and promote that content on and in connection with the platform for as long as needed to operate and improve the service.

You represent that you have all rights needed to upload the content and that it does not violate law or third-party rights. You are solely responsible for your content and for interactions that result from it.

14. Intellectual Property

• EstateLoop owns the platform, branding, software, databases, and design elements
• You may not copy, modify, distribute, or create derivative works from our platform except as allowed by law
• Feedback you provide may be used by us without obligation to you

15. Disclaimers

The platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, EstateLoop disclaims warranties regarding uninterrupted service, listing accuracy, completeness, fitness for a particular purpose, transaction outcomes, user identity, and third-party conduct.

Verification badges, reviews, or moderation actions are risk-reduction measures only. They are not a warranty that a listing, user, or document is authentic, complete, or legally marketable.

16. Limitation of Liability

To the maximum extent permitted by applicable law, EstateLoop and its owner/operator, directors, employees, and partners will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or for loss of profits, data, goodwill, or business opportunities, arising from your use of the platform or from any transaction between users.

Our total aggregate liability for any claim arising from use of the platform is limited to the amount you paid to EstateLoop for paid features in the three (3) months preceding the claim, or ₹1,000 (INR), whichever is greater, except where liability cannot be limited by law (including mandatory consumer protections that apply to you).

Nothing in these Terms excludes or limits rights that cannot be excluded or limited under applicable Indian law.

17. Indemnity

You agree to indemnify and hold harmless EstateLoop and its owner/operator, directors, employees, and agents from and against claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your content or listings; (b) your breach of these Terms or applicable law; (c) your interactions or transactions with other users; or (d) your infringement of third-party rights — except to the extent caused by EstateLoop's wilful misconduct.

This indemnity does not waive or limit any non-waivable statutory rights you may have as a consumer.

18. Termination

18.1 Voluntary deletion

You may delete your account at any time in the app: Profile → Privacy & data, then type DELETE to confirm. This erases your profile, listings, chats, KYC files, and Firebase Authentication account, subject to the retention exceptions in our Privacy Policy. If you cannot access the app, email privacy@estateloop.in.

18.2 Suspension or termination by EstateLoop

We may suspend or terminate access for reasons including:

• violations of these Terms or our Listing Policy
• suspected fraud, payment abuse, or circumvention of platform controls
• illegal content, harassment, or safety risks to other users
• repeat listing violations or impersonation
• legal, regulatory, or law-enforcement requests

18.3 Paid balances and credits on termination

If your account is suspended or terminated for breach, unused wallet balance, boost credits, or active plan time may be forfeited except where applicable law requires otherwise or we expressly agree in writing. Wallet transaction records may be retained for tax and accounting purposes as described in our Privacy Policy.

Sections that by nature should survive (including disclaimers, liability limits, indemnity, and governing law) will survive termination.

19. Force Majeure

EstateLoop is not liable for delay or failure to perform resulting from causes beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, shortages of transportation, facilities, fuel, energy, labour, or materials, or failures of third-party networks or cloud providers.

20. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date will change when we do. Material changes may be communicated in-app, by email, or via the website. Continued use after the effective date constitutes acceptance of the updated Terms to the extent permitted by law. If you do not agree, stop using the platform and delete your account.

21. Governing Law & Disputes

These Terms are governed by the laws of India. Subject to mandatory consumer protection rights that may apply to you (including rights that may allow you to bring proceedings in your place of residence), courts in Mumbai, Maharashtra shall have jurisdiction over disputes arising out of or relating to these Terms or the platform.
